Terms of Service

Who We Are

Irving Books is operated by Focal Point International LLC ("Irving Books", "we", "us", or "our"). These Terms of Service govern your use of irvingbooks.com and your purchase of products, memberships, gift cards, digital downloads, and other services from the website.

By using the website or placing an order, you agree to these Terms. If a mandatory consumer protection law in your country or state gives you rights that cannot legally be limited, these Terms do not limit those rights.

Plain-English Summary

This summary is here to make the important points easy to find. The full Terms below still apply.

  • Checkout shows the final available products, prices, shipping options, taxes, discounts, and payment total before you pay.
  • Physical books may be printed to order by a specialist print partner, shipped from office stock, or fulfilled by a mixed route. Printed books need production time before carrier delivery time.
  • Office-stock books currently leave on Wednesday or Thursday, so delivery estimates for those books include that dispatch rhythm.
  • Preorders are charged when placed unless checkout says otherwise. They ship when the book is available.
  • Digital downloads are for personal use only and are generally not refundable once accessed, except where the law requires or where we need to fix a technical problem.
  • Gift cards do not expire, but they are currency-specific and usually cannot reduce an order to zero because the payment processor requires a small card charge.
  • Rewards, referral points, student discounts, and membership perks are benefits, not cash. Some perks are instant; physical, editorial, acknowledgement, and early-access perks may require manual fulfilment.
  • Donations support the stated donation purpose. They are not purchases, store credit, or tax-deductible charitable contributions unless a receipt or campaign page explicitly says otherwise.

Using The Website

You may use this website only for lawful purposes. You must not interfere with the website, attempt to access systems you are not authorised to use, scrape at abusive volume, submit malicious code, or use the website in a way that harms customers, staff, payment systems, or fulfilment partners.

We may update, suspend, restrict, or discontinue any part of the website when needed for maintenance, security, fraud prevention, operational reasons, or product changes.

Accounts

You may place eligible orders as a guest or create an account. If you create an account, you are responsible for keeping your login details secure and for activity under your account.

Please provide accurate contact, billing, shipping, and account information. If information is incomplete or appears fraudulent, we may delay fulfilment, ask for clarification, cancel the order, or close the account.

Some legacy customer and order records from the previous Irving Books store may be shown in your account when the email address matches. If you believe a legacy order is missing or linked incorrectly, contact us and we will investigate.

Products And Descriptions

We aim to keep product pages, prices, formats, images, ISBNs, stock status, preorder status, publication details, and descriptions accurate. Historical publishing data, old editions, print-on-demand files, and imported catalogue records can contain mistakes, so we may correct errors when we find them.

Product images, mockups, slipcases, bindings, paper tone, dimensions, and cover finishes may vary between editions, production runs, and fulfilment routes. If a difference would be material to your purchase, ask us before ordering.

We may refuse, cancel, or refund an order if the product is unavailable, incorrectly priced, incorrectly described, subject to fulfilment restrictions, or affected by an obvious technical error. If that happens, we will contact you and refund any amount already paid for the unavailable item.

Orders, Acceptance, And Payment

Placing an order is an offer to buy the selected products. We accept the order when payment is authorised and we send an order confirmation or begin fulfilment. Order emails can occasionally be delayed by email providers, but the website order record and payment record remain the source of truth.

Payments are processed by third-party payment providers such as Stripe. We do not store your full card number. Your payment provider may apply its own terms, fraud checks, authentication requirements, currency conversion, or card fees.

We may cancel and refund orders that appear fraudulent, abusive, unlawful, impossible to fulfil, or created to exploit a pricing, discount, rewards, or checkout error.

Prices, Currency, Taxes, And Duties

Store prices are usually shown in US dollars unless another currency is displayed. Some products or services may use a different currency, including memberships billed in pounds sterling. Checkout is the final place to confirm the currency, shipping charge, taxes, discounts, gift-card application, and total before payment.

Prices can change without notice, but changes do not affect an order already accepted unless there was an obvious error.

For international orders, import duties, customs fees, VAT, GST, brokerage charges, or local taxes may be payable on delivery unless checkout explicitly collects them. Those charges are set by your country or carrier and are your responsibility.

Shipping And Fulfilment

Physical books may be fulfilled by a specialist print-on-demand partner, shipped from office stock, or split between fulfilment routes. Printed-to-order books are normally produced after purchase, so the delivery estimate includes both printing time and carrier time. Office-stock books currently dispatch on Wednesday or Thursday, so the dispatch day is part of the realistic delivery window.

The delivery methods and prices shown at checkout are based on the items in your cart, destination, fulfilment route, weight, and available carriers. Final services may include Royal Mail, USPS, or other tracked carriers depending on the destination and fulfilment route.

Delivery dates are estimates, not guarantees. Postal delays, customs inspections, severe weather, incorrect addresses, carrier disruption, payment review, and high-demand periods can extend delivery time. If we cannot ship within the stated or expected window, we will try to notify you, provide an updated estimate, and explain your cancellation or refund options.

Full current shipping information is available on the Shipping page.

Preorders And Backorders

Preorders and backorders reserve a product before it is ready to ship. Unless checkout says otherwise, payment is taken when you place the preorder. Publication, print, and fulfilment dates can move because of editing, printing, supply, author, or fulfilment delays.

If a preorder date changes materially, we will aim to update the product page or contact affected customers. You may request cancellation and a refund before fulfilment begins. Once a preorder has entered printing, packing, or dispatch, the normal returns process applies.

Digital Downloads

Digital products, including ebooks, audiobooks, PDFs, and other downloads, are supplied for your personal, non-commercial use. Unless the product page says otherwise, digital files are DRM-free.

You receive a non-exclusive, non-transferable licence to download and use the file. You must not resell, redistribute, upload, share publicly, remove copyright notices, or use the files for commercial purposes without written permission.

Download links are normally sent by email and may also appear in your account. Links are currently intended to remain active for 30 days. If you have a genuine technical problem accessing a purchase, contact us and we will try to provide a replacement link or suitable file.

Digital downloads are generally not refundable once the download has been accessed, except where required by law or where we cannot resolve a technical issue with the file.

Gift Cards And Store Credit

Irving Books gift cards and store-credit codes are delivered by email. Some gift cards may be scheduled for a future send date. Gift cards do not expire unless a specific promotional code says otherwise.

Gift cards are currency-specific and must be used with an order in the same currency. They are not cash, cannot be redeemed for cash, and are generally non-refundable except where required by law.

Because our card processor requires a small minimum card charge, a gift card or store-credit code may not be able to reduce an order total to zero. Any unused balance remains on the code until it is spent.

Treat gift-card codes like cash. We are not responsible for use by someone who obtains the code from you, your email account, or an incorrect recipient address you provide.

Discounts, Student Offers, And Promotions

Discount codes, student discounts, automatic offers, membership discounts, referral rewards, free-shipping offers, and other promotions may be subject to eligibility rules, product exclusions, usage limits, expiry dates, minimum spends, territory restrictions, or one-promotion-per-order limits.

Student discounts are for eligible student email addresses and verified student accounts. We may revoke or adjust a student discount if eligibility cannot be confirmed or if the discount is shared, resold, abused, or used contrary to the offer terms.

If a discount or promotional price is applied incorrectly because of a technical error, we may correct the order, ask you to confirm the corrected price, or cancel and refund the order.

Rewards And Referrals

Irving Books rewards points, referral points, badges, perks, and loyalty tiers are promotional benefits. They have no cash value, cannot be sold or transferred, and do not create a stored-value account unless they are redeemed for store credit or a gift-card code.

Points may be earned for eligible purchases, account activity, reviews, referrals, sharing, or special campaigns. We may adjust, reverse, or cancel points for returned orders, refunded orders, cancelled orders, fraud, abuse, duplicate accounts, self-referral, or technical error.

Some rewards are automatic, such as certain store-credit or digital-download redemptions. Other rewards, including physical items, acknowledgements, early access, and editorial perks, may require manual review or fulfilment and are not instant unless the reward page explicitly says so.

Memberships And The Irving Circle

Memberships, including The Irving Circle, are subscription products billed through Stripe in the currency shown at checkout. Benefits apply while the membership is active and may include discounts, early access, free-shipping offers, reading material, limited editions, acknowledgements, events, or other perks depending on the tier.

You may cancel a membership through the available account or billing portal flow, or by contacting us. Cancellation normally stops future renewals; benefits may continue until the end of the paid billing period unless the membership was cancelled for abuse, fraud, chargeback, or breach of these Terms.

Physical, event, acknowledgement, signed, or limited-edition perks depend on availability, production, location, scheduling, and fulfilment route. They have no cash equivalent unless we explicitly offer one.

Donations

Donation pages allow you to make voluntary one-time or recurring contributions to the purpose stated on the page, including David Irving's care costs, publication work, archive preservation, or related support campaigns. Donations are not purchases of goods unless the page clearly includes a specific reward or product.

Donations are not tax-deductible charitable contributions unless the donation page or receipt explicitly says so. Recurring donations continue until cancelled through the available billing flow or by contacting us.

Donations are generally non-refundable, but we will review requests involving duplicate donations, unauthorised payments, obvious mistakes, or technical errors.

Returns, Refunds, And Cancellations

Our returns and refunds process is explained in detail on the Returns & Refunds page. You can start an eligible return or refund request through the refund request form.

As a voluntary store policy, we accept returns of eligible physical books requested within 30 days of delivery, provided the books are unused and in resaleable condition. You normally pay return shipping unless the product was damaged, defective, or incorrectly supplied.

Damaged, defective, or incorrectly supplied items should be reported promptly with order details and photos where possible. We may offer a replacement, refund, or other suitable remedy.

Refunds are normally sent back to the original payment method after we receive and inspect the return, verify the issue, or approve the request. Bank and card processing times are outside our control.

If mandatory consumer law gives you additional cancellation, faulty-goods, or digital-content rights, those rights continue to apply.

Reviews, Comments, And Other Submissions

If you submit reviews, comments, support messages, product questions, testimonials, suggestions, or other content, you must have the right to submit it and it must not be unlawful, defamatory, abusive, deceptive, spam, or infringing.

You grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, edit for length or clarity, and publish that content in connection with Irving Books, the website, products, marketing, customer support, and administration. We may moderate, remove, or decline to publish submissions at our discretion.

Intellectual Property

The website, design, text, images, product photography, logos, trade dress, book descriptions, downloadable files, and other content are owned by Focal Point International LLC, Irving Books, authors, publishers, licensors, or other rights holders.

You may not copy, reproduce, scrape, sell, redistribute, create derivative works from, or commercially exploit website content or digital files without written permission, except for limited uses permitted by law such as fair quotation for review, reporting, or commentary.

Book Content And Historical Material

Irving Books publishes and sells historical books, archival material, commentary, and related research. Views, arguments, or claims in books, reviews, quoted material, archival documents, or third-party submissions belong to their authors or sources and do not necessarily represent every view held by Irving Books, its staff, fulfilment partners, or payment providers.

We try to describe books and archive material accurately, but the contents of historical works may include contested claims, period language, or source material that readers may disagree with or find offensive.

Third-Party Services And Links

The website may use or link to third-party services, including payment processors, fulfilment partners, shipping carriers, email providers, analytics tools, fraud-prevention providers, video platforms, social networks, and external websites.

We are not responsible for third-party websites or services we do not control. Their own terms, privacy policies, delivery rules, and service limits may apply.

Privacy, Cookies, And Marketing

Our handling of personal information is explained in the Privacy Policy. Cookie and consent information is explained in the Cookie Policy.

Marketing emails, newsletters, abandoned-cart messages, product alerts, and account messages are handled according to the consent and unsubscribe options shown at signup, checkout, or in the message itself. Transactional emails about orders, downloads, refunds, security, and account activity may still be sent when necessary to provide the service.

Security And Availability

We work to keep the website available and secure, but we do not guarantee uninterrupted service, error-free operation, permanent product availability, or permanent access to every feature.

You must not attempt to bypass security controls, access admin areas, test stolen payment details, attack the website, or misuse customer, order, rewards, gift-card, or account systems.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, loss of data, or loss of goodwill arising from your use of the website or products.

To the fullest extent permitted by law, our total liability for a claim relating to a product, order, membership, gift card, donation, or service is limited to the amount you paid for the item or service giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights, rights relating to faulty goods, or any liability for fraud or fraudulent misrepresentation.

Indemnity

You agree to indemnify and hold harmless Focal Point International LLC, Irving Books, and their officers, employees, contractors, and agents from claims, losses, liabilities, damages, and expenses arising from your misuse of the website, breach of these Terms, unlawful submissions, infringement of third-party rights, fraud, or abuse of checkout, rewards, discounts, gift-card, or account systems.

Governing Law And Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Subject to any mandatory consumer rights that apply where you live, legal disputes will be handled in the courts of Travis County, Texas.

Before either side starts a formal dispute, please contact us so we can try to resolve the issue directly.

Changes To These Terms

We may update these Terms when the website, products, fulfilment routes, payment options, rewards, memberships, laws, or business operations change. The updated date at the top of this page shows when the Terms were last revised. Continued use of the website after changes are posted means you accept the updated Terms.
